 Terms of Trade
Scope of Application
(1) All goods and services are subject to the following General Terms of Trade. Terms and conditions different from those specified herein are only effective if expressly approved.
(2) These General Terms of Trade also apply to future business relations, even if they are not expressly agreed upon in advance.
(3) Orally made collateral agreements must be documented on durable data loggers, e.g. email. Modifications of the rules, including confirmation clauses, as well as agreements on delivery times, firm or without engagement, require documented confirmation. Offers, Conclusion of a Contract, Performance and Delivery Obligations
(1) Offers on these websites are without engagement, unless otherwise specifically agreed as binding. Orders are only considered to be firm if acknowledged and carried out by shipment of the goods. Orally agreed collateral arrangements are not effective without a written confirmation.
(2) The contract is created by the customer emailing an order or filling in and confirming the form on the web and acknowledging and proceeding with the order.
(3) The delivery takes place normally within two working days after entrance of your payment. The statements over the time of delivery are not binding as far as the the date of delivery was promised obligingly. Prices and Conditions of payment
(1) List prices quoted on the web sides are valid at the time of ordering.
(2) All prices are in Euros and subject to change without notice.
(3) For packaging and freight additional costs will be charged to End Users. Software Product
(1) The Software Product purchased by the customer includes a license for the use of the software product in accordance with the license conditions.
(2) Starting with the first use of the software package, the customer accepts these license terms and conditions. The software product remains the intellectual property of the licensor. When using products delivered, the proprietary rights of third parties must be observed.
(3) The customer must protect himself from the loss of data. Because new installation or a modified installation of the software can create risk of loss of data, the customer must take care that the data are secured by all means available. Warranty/Exclusion of Liability
(1) We disclaims any express or implied warranties of fitness for a particular purpose and merchantability. Releasing a new version of software does not constitute a defect of the previously sold software.
(2) You use this software product at your own risk. The manufacturer and developers accept no liability for damages that are caused directly or indirectly by the hardware or the software product. In particular, absolutely excluded is liability for damages for lost profit, business interruption, loss of data or damage to other software or hardware, provided that the manufacturer and developers is liable wilful action or for gross negligence. The customer is not permitted to assign or transfer rights and obligations arising from the contract. Disputes
If a part, provision, or clause of the terms and conditions of sale, or the application thereof to any person or circumstances, is held invalid, void or unenforceable, such holding shall not affect and shall leave valid all other parts, provisions, clauses or applications of the terms and conditions remaining, and to this end, the terms and conditions shall be treated as severable. (1) All personal data obtained will be treated confidentially.
(2) The use of published postal addresses in the Impressum, e.g. telefone or fax numbers and email addresses for marketing purposes is prohibited.
(3) Sending of unwanted spam messages will be prosecuted. Retraction-right
Since through personalized data free-switched software, on the basis of her nature, not for a return against reimbursement of the purchase-price is suitable, a return is not possible (defined by German law § 312d BGB, Abs. 4). Therefore, orders of the software are final. You have the possibility to test the software before you purchase and to catch up further information when required. |
